J. Whitney denies a nails business’s motion to stay litigation following allegations of patent infringement brought by a pedicure spa chair company. The company claims the nails business contributed to patent infringement when it purchased a particular chair model from a third party in Texas, which it sued five months previous to the current suit for similar reasons. The nails business agreed to be bound by the final outcome of the Texas case, not “any outcome,” as it argues here. Because the Texas case has not resolved and to the similarity of the cases, it is inappropriate to grant a stay.

J. Bennett grants Poshmark its motion to dismiss allegations of patent infringement brought by a company specializing in light-up shoes. The company claims that Poshmark replicated and sold one of its shoe models without permission. J. Kendall grants the plaintiff auto parts manufacturer's motion to partially dismiss the defendant auto parts manufacturer's patent counterclaims. J. Jenkins partially grants BMW’s motion to dismiss an amended patent infringement complaint brought against it by a auto part manufacturer. The court dismisses the claims related to three individual patents — for engine valve timing calculation methods, an electronic throttle control system and a power consumption measuring device — and dismisses another complaint until the part manufacture can address the court’s questions of jurisdiction, but allows the other claims to survive.

J. Bucklo denies the plaintiff laminating company’s motion for summary judgment on patent infringement claims it brings against its competitor, the defendant laminating company. J. Doughty denies a request by a Louisiana-based baby products manufacturer for permission to amend its answer to a patent infringement suit, arising from its “no tears” pail for shampooing a baby’s hair. At issue is whether the baby-bucket maker and other businesses named in the suit have “an unfettered right” to alter their answer to the complaint to add “whatever additional defenses and counterclaims they desire. The answer is that they do not.” The patent suit was filed in 2016. Trial is set to begin September 18, 2023.
